Getting an Oakland Demolition Permit Through the Building Bureau

Pulling a building down in Oakland is a paperwork project before it is an equipment project. The City wants to know what is coming off the lot, what is in it, where the debris will end up and who will be hauling it. What follows is a general walk-through, not legal advice. Forms, fees and thresholds change, so confirm current requirements with the City of Oakland Permit Center before you fix dates.

Which office handles it

Demolition inside city limits goes through the City of Oakland Planning & Building Department, specifically the Building Bureau, and applications are filed through the One-Stop Permit Center and its online permit portal. Parcels in neighboring cities or in unincorporated Alameda County answer to different agencies, so check the jurisdiction first, especially near the city line in the hills.

Demolition permit or alteration permit

As a rule of thumb, a full demolition permit applies when more than half of a building's exterior walls come down. Smaller scopes, such as removing a rear addition or gutting the interior, are usually handled as alterations instead. The line matters because it changes the fees, the review and the notice requirements, so ask the Permit Center which path your scope falls into.

A typical sequence

  • Planning and zoning clearance: Planning reviews the proposal before the Building Bureau will issue anything. If the building contains residential units, expect additional Planning Code scrutiny of those units and what replaces them.
  • Historic status check: A property listed or rated by the Oakland Cultural Heritage Survey can trigger review by the Landmarks Preservation Advisory Board and possibly CEQA analysis. See the status before you build a schedule around it.
  • Posted public notice: Demolition applications generally require notices posted around the site and mailed to nearby owners for a notice period. Ask the City for the current count, radius and duration.
  • Hazard survey and BAAQMD notification: The Bay Area Air Quality Management District issues a job number, often called the J number, that is submitted to the Permit Center with the application. Our asbestos guide covers this step.
  • Waste management plan: Oakland expects an approved construction and demolition recycling plan, filed through the Green Halo system, before the permit is issued. A summary report follows before final inspection.
  • Utilities, sewer lateral and curb: Gas, electric and water services are shut off with the utilities. An abandoned sewer lateral generally has to be capped under a Public Works permit, and an unused driveway apron may need to be restored to curb, gutter and sidewalk.

Plan around the approvals, not the machine

On many jobs the approvals, not the excavator, set the calendar. Gathering the survey, the recycling plan and the utility confirmations before you submit tends to prevent rounds of resubmittal. A hauler that is already authorized to work in Oakland also keeps the recycling paperwork straightforward.
